Brush Industries (“Brush”, “we”, “our”, or “us”) is committed to protecting our customers’ privacy. This Privacy Policy describes how Brush Industries collects, uses, and shares the personal information of our clients and users of this website, www.brushindustries.com  (the “Site”). We will periodically update this Privacy Policy and reserve the right to change the provisions of this Policy or our privacy practices at any time. The latest revision will be posted on the website for your review. Your use of the Site or Brush Industries products or services constitutes consent to any changes in this Policy as in effect on the date of such use.

PERSONAL INFORMATION DEFINED

Personal information means information that specifically identifies an individual person, such as name, mailing address, email address, phone number, or account number. It may also include other information about you, such as gender, date of birth, or other demographic information, or about your use of the Site, such as IP address, if that other information is linked to your personal information

HOW BRUSH INDUSTRIES COLLECTS YOUR PERSONAL INFORMATION

Brush Industries collects personal information that you provide to us. For example:

  • If you place an order or sign up for services, we may require you to provide us with your name, mailing address, email address, phone number, billing information, and other information.
  • If you apply for a job with Brush Industries, we may ask you to provide more detailed and sensitive personal information required for compliance with our hiring and equal opportunity policies and practices.

HOW BRUSH INDUSTRIES USES PERSONAL INFORMATION

Brush Industries does not sell personal information to third parties and does not transfer or share customers’ personal information between its clients. Brush Industries will share your personal information only:

Brush Industries may also use anonymous or pseudonymous personal information for internal purposes, such as to track the effectiveness of and improve its products, processes, or services. Brush Industries may also share anonymous or pseudonymous data with selected third parties.

HOW BRUSH INDUSTRIES PROTECTS PERSONAL INFORMATION

Brush Industries follows generally accepted standards to protect personal information and information submitted by our clients, both during transmission and once we receive it. Specifically, Brush Industries uses reCaptcha to protect the various contact forms on our website from spam bots and abuse. A third party cybersecurity service performs monthly Payment Card Industry (PCI) security scans of the Brush website. Other deployed security techniques include; network firewalls, virus and malware protection, a secured network environment, Segregation of Duties (SoD), secure passwords and multi-factor authentication. Despite these precautions and processes, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot guarantee or warrant the security of any information you transmit to or from our Site, and you do so at your own risk. Once we receive your transmission, we will take commercially reasonable precautions to protect its security on our systems.

YOUR RIGHTS TO ACCESS YOUR PERSONAL INFORMATION

You have the right to access, correct, or request deletion of personal information about you that Brush Industries has collected. To access, correct, or request deletion of personal information, contact a customer service representative through any of the methods listed at the bottom of this policy. To verify that the request is authentic, we may require that such request be sent from the email address associated with your personal information. While we will comply reasonably and promptly with your requests, we may need to retain some of your information for our own recordkeeping or to fulfill a legal obligation.

DATA TRANSFERS FROM EU TO US

If you provide personal information to us while located in the European Economic Area (“EEA”), you consent to the transfer of personal information to the United States, and potentially to other countries outside of the EEA. You understand that the current laws of countries outside of the EEA may not provide the same level of protection as the data protection laws of the EEA. If you provide data about other individuals you agree that you have obtained consent from each such individual to the submission and processing of such information to the terms of the Policy, including without limitation the transfer of such data to the United States. Nonetheless, we will take all reasonable steps to protect your privacy in accordance with the applicable data protection laws.

You are under no statutory or contractual obligation to provide any personal information to us. However, if having your personal information is necessary to supply goods or services to you, and you do not provide it, then we will not be able to fulfill that order for goods or services.

CALIFORNIA PRIVACY POLICY (“CCPA”)

Effective January 1, 2020 the California Consumer Privacy Act (“CCPA”) provides for several new rights related to your Personal Information as a California Consumer (Personal Information and California Consumer both as defined in the CCPA). This privacy policy will set forth the following disclosures:

  • The categories of personal information (data) we have collected on our website over the past twelve (12) months;
  • the sources of each of those categories of data;
  • why and how we use your data, and with whom we have shared it in the past twelve (12) months;
  • the new rights you may have under the CCPA; and
  • how to exercise your rights with respect to your personal information that Brush has collected.

It is important to note that Brush does not sell your personal information, therefore; the applicable sections of the CCPA which pertain to your rights in regards to the sale of your personal data do not apply and as a result are not addressed in this policy.

We are however obligated to update this policy every twelve (12) months, so if those practices ever change, those changes will be updated within this Policy. Further, our website is not intended for children under sixteen (16) years of age. No one under age sixteen (16) may provide any personal information to or on our website. We do not knowingly collect personal information from children under the age of sixteen (16). If you are under sixteen (16), do not use or provide any information on this website or on or through any of its features. If we learn we have collected or received personal information from a child under the age of sixteen (16) without verification of parental consent, we will delete that information. If you believe we might have any information from or about a child under the age of sixteen (16) please notify use immediately via the Contact Information provided at the end of this Policy.

 We (and our service providers) have also used certain technologies to automatically collect the following information if you have visited our website in the last twelve (12) months:

  • Your browsing history (browser type and version, location and time zone setting, browser plug-in types and versions, operating system and platform, page response times and download errors);
  • Your search history (information about your visit, including the websites you visit before our website and products and services you viewed or searched for);
  • Any information regarding Your interaction with our website (number of visits, length of visits, pages viewed, page interaction information such as; scrolling, clicks, mouse overs, and methods used to browse away from the page; and,
  • Your Geolocation data.

II. Sources of Data Collected

Brush collects personal information directly from you. We collect your personal information if you fill out the text box on our website “Contact” or “Get a Quote” page at: https://www.brushindustries.com/about-us/contact-us/contact-us~form.aspx or https://www.brushindustries.com/quotes/quote-form/quote~form.aspx ;or You e-mail or contact us directly with your request, contact information and other personal information.

Brush uses Moz and Google Analytics to automatically collect the technical information specified in Section I(B) above.

III. Why and How We Use Your Personal Information

  • To ensure that content from our website is presented in the most effective, user friendly manner for you and your computer
  • To set up and manage your website registration (name, address, IP address, and website usage information).
  • To provide the Company you represent (or you directly) with requested products or services, and subsequent customer service.
  • To allow us to respond to your queries and requests, including to identify you when you contact us.
  • To allow you to participate in various features of our service including any surveys, or downloading of technical documents, firmware or applications.
  • In order to provide you with information about our products and services (provided that you have consented to this when required).
  • To notify you about changes to our products and services
  • To manage our risks and to help identify illegal activity, as required under applicable law.
  • To comply with legal and regulatory requirements.
  • To keep internal records in order to manage our relationship with you.

IV. Understanding Your Rights

The CCPA provides new rights to California consumers. You are a California consumer if you are a California resident (as defined in the CCPA), regardless of whether or not you have a customer or any other relationship with Brush.

A. Right to Know

You have the right to request disclosure of our data collection and sales practices in connection with your data, including the categories of personal information we have collected about you, the source of the information, our use of the information and, if information was disclosed or sold to third parties, the categories of personal information disclosed or sold to third parties and the categories of third parties to whom such information was disclosed or sold. You have the right to request this specific personal information collected about you during the twelve (12) months prior to your request.

B. Right to Request Deletion

You have the right to request that Brush delete your data. However, it may be necessary for us to maintain your personal information under certain circumstances. For example, we may not be able to delete your data if we require your data to complete a transaction with you, to provide a good or service to you, to comply with legal obligation, to enable internal uses which are reasonably aligned with your expectations based on a relationship with the business, to detect security incidents or malicious, deceptive or fraudulent activity, or otherwise to use your personal information internally and lawfully in a way that is compatible with the context in which you originally provided the information and with the data retention exceptions provided under California law.

C. Right to Request Information Not Be Sold to Third Parties

You have the right to request that Brush not sell your information to third parties. However, Brush does not sell personal information to third parties, and will update this policy if those practices change in the future.

D. Right Not to Be Discriminated Against Because You Exercise Your Rights

The CCPA prohibits Brush from discriminating against you for exercising your CCPA rights. This means that Brush may not charge you a different price, deny you goods and services, or impose penalties on you because you elected to exercise your rights.

V. How to Exercise Your Rights

We accept our responsibilities (as defined by the CCPA) to you under the CCPA and as such; if you have any questions about this policy, or wish to exercise any of your rights, we have established several ways in which you can notify us as defined in the contact information section below. Brush is bound by the CCPA to ensure all requests are verifiable, so please include your name and e-mail address at a minimum so that we can follow up with you appropriately.

Upon receiving your request, we will promptly acknowledge receipt and begin the verification process. Once we are able to complete the verification process, we will provide you with an estimate of when you can expect your request to be fulfilled; or, if we cannot comply with your request, we will inform you of that and the reason(s) why in writing.
